When creating an account with RWD you, as a user or contributor, agree to the terms set out below.
We at RWD encourage everyone who uses our platform to respect each other in the spirit of rugby and to help create a thriving and useful online rugby community.
Your RWD Account
As with so many websites and social media, to use the Rugby World Directory you must firstly register and create an Account. We have kept this process as simple as possible. Once you have registered you can use the Directory resource, create Personal and Non-Personal profiles and book flights and accommodation.
We hereby advise you that you are responsible for all the activity that occurs on your Account and stringently advise you to keep your password secure. Do not use anyone else’s Account without their permission and do not create an Account as someone else. Please advise RWD should your Account be used by others or if there is a breach of security in some way.
RWD accepts no liability for damages resulting from the use of your account, unauthorised or otherwise, and you should be aware of your own liability as you use the resource.
Further, we stringently advise you that by agreeing to the Terms & Conditions you will NOT: provide false information, create more than one personal Account, create an Account if you are a convicted sex offender or create an Account with a user name that infringes upon Trademark or Copyright.
Age & Acceptance
To use RWD you have to be 16 years of age or older. RWD assumes that Account Holders between the ages of 16 and 18 have legal parental or guardian consent and are fully able to accept the terms as stated here.
Schools rugby is a vibrant and essential part of the rugby community. RWD welcomes all involved in schools rugby, from players, coaches through to parents and friends. RWD takes extremely seriously all of our responsibilities towards providing a healthy and safe environment for young people to interact with each other and the broader rugby community.
Using RWD
We trust that you will use RWD honestly and through the means presented to you. Use RWD only as permitted by law and be aware that should you not comply with our terms, the law or if we suspect misconduct, we will terminate your use of our platform.
RWD retains the rights to its intellectual property. As such you cannot use our content, images, maps, icons, brand, trademarks and logos without our express written permission. Anyone acting as RWD or its subsidiaries without the express written permission of RWD will be prosecuted to the fullest extent of the law.
Currently RWD has an affiliate relationship with the World Ticket Centre and Bookings.com. The content and function of these websites is the sole responsibility of these providers.
As an Account Holder, RWD will need to communicate with you for various reasons. This may occur through messages or e-mail. For some of these communications it will be possible for you to opt out.
Claiming a Non-Personal Profile
We have pre-loaded our Directory with various rugby related Non-Personal profiles. These profiles are ready for "claiming". RWD has created a "Claim Profile" protocol to ensure that those who claim a profile have the right to do so. RWD assumes that, in the spirit of rugby and our community, our users only claim profiles that are rightfully theirs to claim. Should RWD discover that a Non-Personal profile has been claimed and appointed to an Account Holder who does not have the rights to that Non-Personal profile then RWD will take the following action: 1. The Account Holder will have their Account terminated and will be banned from using RWD. 2. The Non-Personal profile will be made claimable again and will be stripped of content. 3. RWD will attempt to contact the rightful owner of the Non-Personal profile to discuss the appropriate course of further action.
Content
As a part of using social media we understand that you will be displaying and sharing content. The content you display is your responsibility. You can control who sees your content through the "Dashboard". Given certain circumstances we may review content to make sure that there is nothing illegal or disrespectful going on.
If you are an entity and are using content, trademarks, logos and images RWD will assume that you have the right to use these intellectual property items. Use of trademarks, logos and brands should comply with the terms as set out by the owners.
Your own content remains yours and obviously you retain ownership and rights. Given that our community may want to promote you or your business to their own community you agree to this sharing of your content as a natural part of using RWD.
RWD retains the right to share your content where it enhances the interaction of our community, for example as a "Team of the Month", "Event of the Month" and so on. We may use your content in our blog or share it throughout the rugby community. By agreeing to these Terms you provide RWD in essence with a royalty free license to use your content and the Intellectual Property elements that you post and share. Naturally this ends should you terminate your use of RWD. Where appropriate we will communicate this with you and so confirm your permission.
To be clear, RWD assumes that you have the rights to use the content that you upload, post and share.
RWD will not be held accountable for the content to which you are exposed. This pertains to its accuracy, usefulness, safety or the intellectual property rights associated with it. Should you be exposed to content that you find inaccurate, indecent, offensive or disagreeable then we are sorry. However, by registering with RWD and becoming an Account Holder you accept that this is possible and waive your rights to any legal action against RWD.
Changes to RWD
The Rugby World Directory is a work in progress. We will be changing and adding functionalities and features to enhance your experience improve the resource and bring the greater rugby community closer together.
Liability
RWD and its employees, agents, officers or directors cannot be held liable to you for possible direct, indirect, incidental, special, punitive or consequential damages as a result of (1) errors, mistakes or inaccuracies of content, (2) injury or damage resulting from access to and use of RWD, (3) unauthorised use and access to our servers and the information stored therein, (4) interruption, crash or failure of the website to function (5) bugs, viruses, Trojan horses etc. transmitted through RWD by third parties (6) incorrect, incomplete, erroneous or inaccurate content whether posted, e-mailed or transmitted through RWD.
The risk of offense, harm or damage from defamatory, offensive or illegal conduct by a Third Party rests entirely with you.
RWD is an international platform that crosses cultural boundaries and cannot determine whether or not the platform is appropriate for use in any particular culture. Account Holders use RWD under the jurisdiction of and in compliance with local law and do so at their own volition.
Warranties
RWD and its officers, directors, employees and agents make no warranties, implied or otherwise, with regard to the accuracy or completeness of the sites content or any of the sites of which RWD is an affiliate. Further, RWD does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a Third Party through it or any hyperlinked service through any form of advertising. RWD is not a party to or in any way responsible for transactions and purchases entered into with its affiliate partners. Purchases and bookings made with these affiliate partners are entirely at your own risk.
Disclaimer
You agree that, should your use of RWD, be in violation of these Terms, violation of copyright, violation of property, violation of privacy or lead to any Claim(s) that your content caused damage to a Third Party, you will defend, indemnify and hold harmless RWD, its holding company, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).
This defence and indemnification obligation will survive these Terms and your use of RWD.
Business
Many of you will be using RWD as part of your role in or as a business. The Terms of use apply equally to your business and your business accepts these terms as you do. Your business holds RWD harmless and indemnifies RWD and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the website or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
Termination of your Account
RWD reserves the right to decide whether or not to terminate your Account should you violate any of our Terms or Community Guidelines. This applies in particular to repeat offenders.
Advertising
RWD will only place advertisements for organisations (Brands, Destinations and Travel) that have a true affinity with the rugby community. Any Deals that we present to you will, by virtue of our demographic segmentation, appeal to you and your interests.
Changes to Terms
Our goal is to keep our "Terms & Conditions" up to date and legally defendable. We reserve the right to change these Terms as appropriate, whether through outside stimulus, legal advice or as a result of extensive RWD community feedback. By agreeing to the Terms & Conditions upon registration you indicate your understanding of the aforementioned.
Disputes
No-one wants to go into the courts to rectify a dispute. Taking the legal path is expensive and time consuming. If there is an issue RWD hopes that you will contact us to see if we can settle the problem through a mediation process without the need of lawyers. However, RWD will aggressively protect its rights should we feel that we are subject to an unfair claim or attack.
